ดุษฎีนิพนธ์นี้มีวัตถุประสงค์ คือ 1. เพื่อศึกษาการปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัวภาค 2  2. เพื่อศึกษาปัจจัยที่ส่งผลต่อการปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัวภาค 2  3. เพื่อนำเสนอการบูรณาการหลักพุทธธรรมเพื่อส่งเสริมการปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัวภาค 2 เป็นการวิจัยแบบผสานวิธี การวิจัยเชิงปริมาณโดยแจกแบบสอบถามกับบุคลากรศาลเยาวชนและครอบครัวภาค 2 ใน 4 จังหวัด คือ จังหวัดระยอง จังหวัดชลบุรี จังหวัดจันทบุรี และ จังหวัดนครนายก ซึ่งเป็นกลุ่มตัวอย่างจำนวน 187 คน สุ่มตัวอย่างแบบชั้นภูมิ เครื่องมือที่ใช้ในการเก็บรวบรวมข้อมูล คือ แบบสอบถามมาตราส่วนประมาณค่า 5 ระดับซึ่งมีค่าความเชื่อมั่นทั้งฉบับเท่ากับ 0.991 สถิติที่ใช้ในการวิเคราะห์ได้แก่ ค่าความถี่ ค่าร้อยละ ค่าเฉลี่ย ค่าเบี่ยงเบนมาตรฐานและการวิเคราะห์การถดถอยแบบพหุคูณ ด้วยโปรแกรมสำเร็จรูปทางสถิติ การวิจัยเชิงคุณภาพดำเนินการโดยใช้การสัมภาษณ์เชิงลึกกับผู้ให้ข้อมูลสำคัญจำนวน 18 รูปหรือคน และการสนทนากลุ่มเฉพาะผู้ทรงคุณวุฒิจำนวน 9 คน วิเคราะห์ข้อมูลโดยวิเคราะห์เนื้อหาเชิงพรรณนา

ผลการวิจัยพบว่า

1.       การปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัวภาค 2 พบว่า โดยภาพรวมอยู่ในระดับมากที่สุด เมื่อพิจารณาเป็นรายด้าน พบว่า ด้านเชื่อถือในระดับสากล (Reliability) ด้านความเชื่อมั่นศรัทธาการอำนวยความยุติธรรม (Trusted Justice) ด้านการดำเนินงานอันเป็นมาตรฐาน (Uniformity) อยู่ในระดับมากที่สุด ส่วนการปฏิบัติด้านการเปลี่ยนผ่านสู่อนาคต (Transformity) และด้านพัฒนาที่ยั่งยืน (Sustainability) อยู่ในระดับมาก โดยบุคลากรมีการพัฒนาตนเองอยู่เสมอเพื่อให้มีความรู้ทันสมัยให้ได้มาตรฐานสากล กระบวนการพิจารณาคดีเด็กและเยาวชน รวมทั้งมาตรการก่อนและหลังคำพิพากษามีความเที่ยงตรงและเป็นประโยชน์ต่อเด็กและเยาวชน เสมอภาค เท่าเทียม รักษาสิทธิ ลดขั้นตอนและค่าใช้จ่าย การปฏิบัติมีการสนับสนุนไกล่เกลี่ยเพื่อยุติคดี เพื่อให้ลดคดีสู่ศาลและเน้นการปฏิบัติงานด้านการประนีประนอมให้มากขึ้น มีจริยธรรม รักษาความเป็นกลาง ปราศจากอคติ สะดวก รวดเร็ว ใช้เทคโนโลยีสารสนเทศอย่างมีประสิทธิภาพ จัดระบบการพิจารณาคดี (COJ) ที่เหมาะสม ทันสมัยและคงความยุติธรรม การปฏิบัติตามกฎ ระเบียบ มีข้อกำหนดกฎเกณฑ์ที่เป็นมาตรฐานเดียวกัน มีจรรยาบรรณ ไม่ละเมิดสิทธิและเสรีภาพบุคคลอื่น

2.      ปัจจัยที่ส่งผลต่อการปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัวภาค 2 พบว่า (1) การบริหารจัดการองค์กร ส่งผลต่อการปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัวภาค 2 จำนวน 2 ด้านได้แก่ การประสานงาน และการจัดองค์กร  โดยร่วมกันทำนายได้ร้อยละ 68.9   อย่างมีนัยสำคัญทางสถิติอยู่ที่ระดับ 0.01 (2) หลักสาราณียธรรม 6 ส่งผลต่อการปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัวภาค 2 จำนวน 4 ด้าน ได้แก่ ด้านทิฏฐิสามัญญตา (เชื่อมั่นในหลักการร่วมกัน) ด้านเมตตากายกรรม (ประพฤติตัวสุภาพ จริงใจช่วยเหลือ) ด้านสาธารณโภคี  (มีน้ำใจแบ่งปัน ให้ความร่วมมือช่วยเหลืองาน) ด้านเมตตามโนกรรม (เคารพความคิดผู้อื่น ยึดมั่นจริยธรรม) โดยร่วมกันทำนายได้ร้อยละ 84.1 อย่างมีนัยสำคัญทางสถิติที่ระดับ 0.05

3.      การบูรณาการหลักพุทธธรรมเพื่อส่งเสริมการปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัวภาค 2 ผลการวิจัย พบว่า การบริหารจัดการองค์กร 5 ด้าน ได้แก่ 1) ด้านการวางแผน 2) ด้านการจัดองค์กร 3) ด้านการจัดบุคลากร 4) ด้านการอำนวยการ 5) ด้านการประสานงาน โดยบูรณาการกับหลักสาราณียธรรม 6 คือ เมตตากายกรรม (ประพฤติตัวสุภาพ จริงใจช่วยเหลือ) เมตตาวจีกรรม (สื่อสารเข้าใจ วาจาสุภาพ ปรึกษาหารือ) เมตตามโนกรรม (เคารพความคิดผู้อื่น ยึดมั่นจริยธรรม) สาธารณโภคี (มีน้ำใจแบ่งปัน ให้ความร่วมมือช่วยเหลืองาน)  สีลสามัญญตา (รักษากฎระเบียบ เรียนรู้กติกา มีวินัย) ทิฏฐิสามัญญตา (เชื่อมั่นในหลักการร่วมกัน) เพื่อส่งเสริมการปฏิบัติงานของบุคลากรศาลเยาวชนและครอบครัว ได้ผลการปฏิบัติตามยุทธศาสตร์ คือ สร้างศรัทธาการอำนวยความยุติธรรม ยกระดับมาตรฐานการปฏิบัติเป็นสากล ส่งเสริมความรู้และความสามารถบุคลากร สร้างความยุติธรรม ไม่มีอคติ ใช้เทคโนโลยีให้เกิดประสิทธิภาพ เพื่อสร้างสังคมแห่งความสงบร่มเย็น ดูแลเด็กและเยาวชนให้เป็นคนดีของสังคม

บทคัดย่อภาษาอังกฤษ

Objectives of this dissertation were: 1. To study the performance of Juvenile and Family Court personnel, Sector 2, 2. To study factors affecting the performance of Juvenile and Family Court personnel Sector 2, and 3. To propose the integration of Buddhadhamma principles to promote the performance of Juvenile and Family Court personnel Sector 2. Research methodology was the mixed methods. The quantitative research by distributing 5 rating scale questionnaires that had reliability at 0.991 with Juvenile and Family Court personnel, Sector 2 in 4 provinces, namely, in Rayong, Chonburi, Chanthaburi and Nakhon Nayok provinces, acquired 187 samples. Analyzed data with frequency, percentage, mean, standard deviation and multiple regression using statistical program package. The qualitative research collected data by in-depth-interviewing 18 key informants and 9 participants in focus group discussion and analyzed data by content descriptive interpretation.

Findings were as follows:

1.         The performance of Juvenile and Family Court personnel in Sector 2  

by overall, was found to be at the highest level. When considering each aspect, it was found that Reliability, Trusted Justice and Uniformity, were at the highest level.  Transformity and Sustainability were at the high level. The personnel were constantly developing themselves to have up-to-date knowledge to meet international standards. The juvenile proceedings, including measures before and after the verdict, were precise and beneficial to the juvenile with equality, equity, maintaining rights, reducing process and cost. The practice supported mediation to settle cases in order to reduce cases to court and focus more on conciliation operations. Being ethical, maintaining impartiality without bias, convenience and fast. Efficient use of information technology. Organized a proper, modern and just Confession Of Justice system (COJ). Compliance with regulation There were uniform regulatory requirements with Code of Conduct to avoid infringing on the rights and freedoms of other persons.

Factors affecting the performance of Juvenile and Family Court, Sector 2 personnel were found that: (1) organizational management; It affected the performance of Juvenile and Family Court personnel, Sector 2 in 2 aspects, namely coordination and organization, together with a prediction of 68.9 percent at statistically significant at the 0.01 level. (2) Saraniya-dhamma 6 affected the performance of Juvenile and Family Court, Sector 2 personnel in 4 aspects, namely, Titisamanyata (trust in common principles), Mettakayakamm, (behave politely, sincerely to help), Sataranapogi, (kindness to share, cooperate and help the work), Mettamanokam, (respect for others' thoughts, adhering to morality). Together, the prediction was 84.1 percent at statistically significant at the 0.05 level. Integration of Buddhadharma principles to promote the performance of Juvenile and Family Court, Sector 2 personnel indicated that there were 5 aspects of organizational management, namely 1)  Planning 2) Organization 3) Personnel Manegment 4)  Administration 5)  Coordination to integrated by relying on the 6 principles of Saraniyadhamma, namely, Mettakayakamma.(behave politely, sincerely to help), Mettavacikamma (communicate clearly, Polite speech, consultation), Mettamanokamma, (respect for others' thoughts, adherence to ethics), Sataranapogi,  (Sharing with kindness, cooperation, helping the work), Silasamanyata, (keeping the rules. Learn the rules, discipline), Titthisamanyata,  (believe in common principles) by managing the organization according to the strategy to promote the performance of Juvenile and Family Court personnel, namely to build faith in the administration of justice, to raise the practice to international standards, to promote knowledge and competence of personnel, to create justice without prejudice, and to effectively use technology in order to create a peaceful society and take care of children and youth to be good people of society.
