ดุษฎีนิพนธ์ฉบับนี้ มีวัตถุประสงค์ 1) ศึกษาสภาพปัญหา บริบท ความต้องการพัฒนากระบวนการไกล่เกลี่ยข้อพิพาทของสำนักงาน คปภ. 2) ศึกษาหลักพุทธสันติวิธีที่ส่งเสริมการพัฒนากระบวนการไกล่เกลี่ยในการปฏิบัติหน้าที่ไกล่เกลี่ยข้อพิพาทด้านประกันภัย 3) เพื่อบูรณาการกระบวนการไกล่เกลี่ยข้อพิพาทตามหลักพุทธสันติวิธีของสำนักงานคณะกรรมการกำกับและส่งเสริมการประกอบธุรกิจประกันภัย การศึกษาใช้ระเบียบวิธีวิจัยเชิงคุณภาพ (Qualitative Research)    โดยการศึกษาจากเอกสาร (Documentary Research) และวิธีการสัมภาษณ์เชิงลึก (In-depth Interview) จากกลุ่มผู้ไกล่เกลี่ยชำนาญการของสำนักงาน คปภ. และการประชุมกลุ่มย่อย (Focus Group) ประกอบด้วยผู้เชี่ยวชาญด้านพระพุทธศาสนา ผู้บริหาร และผู้เชี่ยวชาญด้านการไกล่เกลี่ยประกันภัย ของสำนักงานคณะกรรมการกำกับและส่งเสริมการประกอบธุรกิจประกันภัย ผู้เชี่ยวชาญด้านจิตวิทยาการให้คำปรึกษา

    ผลการศึกษาพบว่า

          สภาพปัญหาบริบทข้อพิพาทด้านประกันภัยของสำนักงาน คปภ. สาเหตุหลักที่สำคัญมาจากความคิดเห็นของผู้ร้องเรียนกับบริษัทประกันภัยไม่ตรงกันในเรื่องของจำนวนเงินอันเป็นค่าสินไหมทดแทนและการรับผลประโยชน์ตามสัญญาประกันภัย ซึ่งปัญหานี้สามารถแก้ไขได้ด้วยการเจรจาไกล่เกลี่ยเพื่อประสานความเข้าใจและหาข้อยุติร่วมกันได้อย่างสันติ จากการศึกษาหลักธรรมตามแนวทางของหลักพุทธสันติวิธี พบว่าการนำหลักธรรมอริยสัจสี่มาบูรณาการเพื่อพัฒนากระบวนการไกล่เกลี่ยข้อพิพาทด้านประกันภัยสอดรับกับการแก้ไขปัญหาข้อพิพาทได้เป็นอย่างดี ซึ่งการบูรณาการกระบวนการการไกล่เกลี่ยข้อพิพาทด้านประกันภัยตามหลักพุทธสันติวิธีมี 5 ขั้นตอน ดังนี้ 1) การเตรียมการไกล่เกลี่ย (รู้ปัญหา รู้ทุกข์) 2) เปิดประชุมไกล่เกลี่ย (มีสติ ใช้ทางสายกลาง) 3) เจรจาค้นหาทางเลือกร่วมกัน (ใช้ปัญญา คิดถูกวิธี ไม่มีอคติ) 4) เจรจาเลือกทางออกที่เหมาะสม (เจรจาถูกวิธี      มีความมุ่งมั่น) 5) สรุปผลการไกล่เกลี่ย (สร้างสันติภาพ เกิดสันติ มีความสงบระงับ) พบว่าการไกล่เกลี่ยข้อพิพาทด้านประกันภัยของสำนักงาน คปภ. สามารถยุติลงได้อย่างสันติวิธี

บทคัดย่อภาษาอังกฤษ

The study consisted of the following objectives: 1) to investigate problems and dispute mediation process of the Office of Insurance Commission; 2) to explore the dispute mediation process based on Buddhist peaceful means; and 3) to propose the dispute mediation process based on Buddhist peaceful means of the Office of Insurance Commission. The study employed a qualitative research method, which included document analysis, an in-depth interview with mediation experts from Office of Insurance Commission, and a focus group discussion with Buddhist experts, Office of Insurance Commission administrators and mediation experts, as well as a counseling psychology specialist.

The results of the study revealed that:

the problem and context of insurance disputes of the Office of Insurance Commission, the main cause is the opinion of the complainant and the insurance company disagreeing on the amount of compensation and receiving benefits under the insurance contract, which this problem can be can be resolved through mediation negotiations in order to harmonize understanding and find a peaceful solution together. From the study of the Dharma principles according to the Buddhist peaceful method, it was found that the integration of the Four Noble Truths in the development of insurance dispute mediation process is well compatible with the resolution of disputes. The integration of insurance dispute mediation according to Buddhist peaceful means has 5 steps as follows: (1) Preparing for mediation (identifying problems and sufferings); (2) Starting the mediation (having mindfulness, take the middle way); (3) Negotiation and solution-seeking (using wisdom, think right, without prejudice); (4) Negotiation and solution-seeking (negotiate the right way, concentrate); and (5) Concluding the mediation (peace building). It was found that insurance dispute mediation by the OIC can be settled peacefully.
