การวิจัยในครั้งนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาบริบทการบริหารจัดการในการให้คำปรึกษาด้านจิตสังคมของศาลยุติธรรม 2) ศึกษากระบวนการบริหารจัดการในการให้คำปรึกษาด้านจิตสังคมของศาลยุติธรรม และ 3) พัฒนาการบริหารจัดการในการให้คำปรึกษาด้านจิตสังคมของศาลยุติธรรมโดยการประยุกต์ใช้หลักอิทธิบาทธรรม ระเบียบวิธีวิจัยเป็นการวิจัยเชิงคุณภาพ โดยหาข้อสรุปจากการวิจัยเชิงเอกสาร การสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญที่เลือกแบบเฉพาะเจาะจงจำนวน 25 รูปหรือคน มีการวิเคราะห์ SWOT Analysis, TOWS Matrix และการสนทนากลุ่มเฉพาะโดยผู้ทรงคุณวุฒิจำนวน 9 รูปหรือคน เพื่อพัฒนาการบริหารจัดการในการให้คำปรึกษาด้านจิตสังคมของศาลยุติธรรม วิเคราะห์ข้อมูลโดยการวิเคราะห์เนื้อหาและการตีความ  

ผลการวิจัยพบว่า

1. บริบทในการบริหารจัดการในการให้คำปรึกษาด้านจิตสังคมของศาลยุติธรรม ได้นำมาใช้กับผู้ต้องหาและจำเลยในความผิดที่ไม่ร้ายแรงซึ่งเกือบทั้งหมดเป็นคดียาเสพติด โดยคำนึงถึงหลักสิทธิมนุษยชน โดยการให้คำปรึกษาเพื่อแก้ไข บำบัด ฟื้นฟูและปรับเปลี่ยนพฤติกรรมใน 3 ระดับ คือ ในชั้นฝากขัง ในชั้นหลังศาลมีคำพิพากษาสำหรับจำเลยที่เคยเข้ารับคำปรึกษา และในชั้นหลังศาลมีคำพิพากษากรณีไม่เคยเข้ารับการปรึกษา

2. กระบวนการบริหารจัดการในการให้คำปรึกษาด้านจิตสังคมของศาลยุติธรรม ตัวแบบในการบริหารจัดการในการให้คำปรึกษาด้านจิตสังคมของศาลยุติธรรม มีประเด็นสำคัญใน 4 มิติ คือ วางแผน ดำเนินงาน ประเมินผล และสะท้อนกลับผล บนพื้นฐานปัจจัยสำคัญทางการบริหารจัดการ 3 ประการ คือ บุคลากร งบประมาณ และทรัพยากรหรือหลักการบริหาร โดยมีเป้าประสงค์ที่จะเป็นรูปแบบการบริหารจัดการคลินิกจิตสังคมของศาลยุติธรรมที่จะก่อให้เกิดอรรถประโยชน์ให้กระบวนการยุติธรรมทางเลือก

3. การพัฒนาการบริหารจัดการในการให้คำปรึกษาด้านจิตสังคมของศาลยุติธรรมโดยการประยุกต์ใช้หลักอิทธิบาทธรรม 1) ด้านความพอใจ 2) ด้านความเพียรพยายาม 3) ด้านความมุ่งมั่น และ 4) ด้านความรอบคอบและรอบด้าน โดยมีการหนุนเสริมให้เกิดการพัฒนาการบริหารจัดการให้เกิดความเหมาะสม สอดคล้อง และเป็นไปตามแนววิถีไทยวิถีพุทธ

บทคัดย่อภาษาอังกฤษ

Objectives of this research were:  1. To study the administrative context of Socio-psychosocial counseling service of the Court of Justice, 2. To study the process of administrative development of socio-psychosocial counseling service of the Court of Justice, and 3. To administrative development of socio-psychosocial counseling service of the Court of Justice by applying Itthipada-dhamma, conducted by the qualitative research method, collected data from  documents, In-depth interviews with 25 key informants, purposefully selected, analyzed data by  SWOT Analysis, TOWS Matrix and collected data from 9 participants in focus group discussion for more data to develop the administration socio-psychosocial counseling service of the Court of Justice. Data were analyzed by content descriptive interpretation.

Findings were as follows:

1. The administrative context of socio-psychosocial counseling service of the Court of Justice has been applied to convicts and defendants of non-serious offenses, almost all of which were drug offenses by considering the principles of human rights. Counseling for correction, treatment, rehabilitation, and behavior modification was available at 3 levels: in custody; In the latter stage, the court had a verdict for the defendant who previously attended counseling, and in the latter stage, the court had a verdict for the case of never attending counseling.

2. The process of administrative development of socio- psychosocial counseling service of the Court of Justice, the administrative model of socio-psychosocial counseling service of Courts of Justice consisted of 4 key dimensions: planning, implementing, evaluating, and results feedback, based on 3 key management factors: people, budget, and resources or management principles. The objective was to be a form of management of the socio-psychosocial clinic of the Court of Justice that will provide utility to the alternative justice process.

3. The administrative development of socio-psychosocial counseling service of the Court of Justice by applying Itthipada-dhamma, consisted of: 1) Satisfaction 2) Perseverance, 3) Commitment, and 4) Prudence and all-roundedness. It was supported to develop the administration to be appropriate, consistent and in accordance with the Thai way, the Buddhist way.
